Article 1: Scope of application and acceptance

These conditions of sale are concluded, on the one hand, the company "A 3 Mains" to the capital of 9000 euros whose head office is located at 49 petite rue de la fontaine - 71250 Cortambert - FRANCE, registered in the register of trade and companies of Mâcon under the number 878 895 739 below referred to as " Fraise & Bois and on the other hand, by any physical person referred to as "Customer" wishing to make a purchase via the website of Fraise & Bois https://fraise-et-bois.fr/gb/, below referred to as "the Site".

These terms and conditions of sale are intended to define the contractual relationship between the site Fraise & Bois and the Customer and the conditions applicable to any purchase made through the merchant site Fraise & Bois whether the Customer is professional or consumer. The acquisition of a property or service through this site implies an unreserved acceptance by the Customer of these general terms and conditions of sale. These conditions of sale shall prevail over any other general or special conditions not expressly approved by Fraise & Bois. Fraise & Bois reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the Customer.

Article 2: Proposed products and services

2.1 Products

You can find on the site Fraise-et-bois.fr for each product, a product sheet that contains all the characteristics of the product. You have the opportunity to know, before the final validation of your order, all the essential characteristics.

Photographs, graphics, texts : Fraise-et-bois.fr marks its desire to be the most accurate and to respect the reality of the products at best. If a description error appears on a product, we commit to correct it as soon as possible. Pictures of products are non-contractual (colors can also be different from one screen to another). The prices, descriptions and colours of the products of our Internet catalogue are for information purposes only and can be modified according to the supply, manufacturing methods, economic conditions or economic conditions.

The choice and purchase of products is the responsibility of the Customer. The impossibility of using the product purchased for any cause does not imply the responsibility of Fraise & Bois.

However, it is impossible to review all messages. The reviews left on the blog, shop, products, etc... express the views and opinions of their respective authors, not those of society Fraise & Bois which therefore cannot be held liable.

As Customer, you consent not to post abusive, obscene, vulgar, defamatory, threatening, sexual or any other message that violates the applicable laws. This can lead you to be banned immediately on a permanent basis and your Internet provider will be informed of this. The IP address of each message is registered to help enforce these conditions.

Article 3: Price

3.1. Price display

The prices displayed on the Site are indicated in euros (€) all French taxes included (VAT and all other applicable taxes). These prices do not include shipping, packaging and insurance fees.

Prices can be changed at any time, unilaterally, without prior information, depending on the supply and economic conditions, the tariff policy and the hazards.

3.2 Sale outside Metropolitan France

Any sale to an area other than metropolitan France puts the customer in an importer's position - which will ensure under its sole responsibility the entry of the goods into the territory of destination, will carry out all the necessary steps, and will take charge of any taxes, customs or import duties and more generally payable thereto.

Article 4: Orders

Orders are effective from the notice of payment for cheques or bank transfers and from the date of validation of the payment by the competent banking institutions, for bank cards.

For reasons of limitations of bank fraud, it may be requested from the customer, the provision of documents justifying the client's identity and the truthfulness of the order. In this case, the orders will be validated as soon as the supporting documents of the client's identity have been approved by the services Fraise & Bois.

The seller reserves the right to cancel or refuse any order of a customer with whom a dispute concerning the payment of an earlier order exists. Any order is to accept the prices and description of the products available for sale.

The acceptance of the Customer, such as an electronic signature, is realized by acceptance during the order process (step 4 - payment). This electronic signature is a handwritten signature between the parties. The electronically validated order constitutes an irrevocable acceptance that can only be challenged in the context of the right of withdrawal.

Article 5: Availability

Any offer of sale shall be subject to available stocks. You can find information on the availability of the product on each Product Sheet.

The product may have for availability :
- In stock : available in stock. The product is sent to you upon validation of the payment by the relevant banking institutions for bank cards or upon receipt of the payment for cheques or bank transfers.
- Available soon : not available for sale but during manufacture in our carpentry. We do our utmost to avoid ruptures, and if necessary replenish our stocks as quickly as possible.

The availability of the items is updated in real time. However, it may happen that despite our vigilance an article is missing when preparing your order, you are then informed by email.Note that if your order contains several items, we ship you the rest of your order without delay.

In the event of a final breakdown of the ordered product, we will refund your amount or immediately create an asset of the same amount, unless an exchange is possible (subject to agreement between the seller and the buyer).

We use all this information to provide you with maximum transparency.

Any clause emanating from the buyer, not accepted in writing by the seller, which would be in opposition to these general terms or particularities defined in the price offer will be considered null. No unilateral cancellation of order will be accepted without the agreement Fraise & Bois.

Article 6: Delivery

6.1 Shipping costs

Shipping costs vary. They are calculated automatically according to the weight of your order, address, country of delivery and the carrier you have chosen.

6.2. Order preparation time

Any order of items in stock is prepared on average within 48 to 72 working hours. This deadline is only indicative. If the order exceeds 30 days from the order, the sales contract may be terminated and the customer refunded.

6.3 Delivery time

The deadlines announced on our site are indicated from our workshop and they depend on the carrier you have chosen. Delivery is carried out by the postal system or by an independent carrier with whom Fraise & Bois is committed.
Principle: indicative deadlines not guaranteed. Delivery times are, unless expressly stated otherwise, indicative deadlines, corresponding to the delivery times normally observed for a particular type of benefit and for the purpose of which the carrier, through an obligation of means, makes reasonable efforts. These deadlines are not time-bound commitments and are therefore not guaranteed. The overtaking of such an indicative period of time shall not result in any compensation whatsoever and of any kind, including in the event of proof of injury.

6.4. Delivery area

6.5 Transport

The transport risks are borne by the seller, provided that the buyer has checked the goods at their reception in the presence of the carrier and has served in writing on the transport voucher, if necessary, the reservations observed and this same in case of Franco-Port shipping. Unless otherwise agreed, the seller freely chooses the carrier. In case the package is too damaged, the buyer must refuse it. In the case of a loss of packages when transporting, the time limits for investigation may vary by carriers and take one to four weeks. 6.6 Receipt of goods

In case of receipt of deteriorated product, while the Transport clause has not been used because of packages in perfect condition, the customer must inform Fraise & Bois within 7 days of receipt of the order. Unless expressly stated, the return fee is borne by the customer.

Article 7: Payment

The price is payable in full and in a single payment. All orders are payable in euros (€). For all payments made on the website, the seller reserves the right to accept the sale to ask the buyer to justify his identity and place of domicile.

7.1 Payment by bank card

The regulations can be made by credit card, with CB, VISA or MASTERCARD. Our partnership with Crédit Agricole guarantees you a fully secure payment and data privacy. 7.2 Payment by cheque

The regulation can be made by French bank cheque. To do so, it will have to indicate its name and the number of its command generated automatically by the site, once the order has been validated. The date of the cheque's notice of payment results in the initiation of the order preparation and shipment.

7.3 Payment by bank transfer

The regulation can be made by bank transfer. In order to do so, it will have to indicate the number of its order generated automatically by the site, once the order has been validated. The visualization of the payment of the order on our bank account results in the initiation of the preparation of the order and its shipment.

7.4 Ownership reserve

Pursuant to the law of 12 May 1980, the transfer of ownership of the goods delivered to the Customer will only take place after full payment of the main and incidental price.

7.5 Settlement delay

Any settlement after the payment date fixed could result in the billing of penalties without a prior notice of the purchaser being required. The amount of these penalties would be at least equivalent to the amount that would result from the application of a rate equal to 1.5 times the legal interest rate in effect on the day of the application of the penalties, without excluding additional damages and interests. The customer may never, on the basis of a claim made by him, retain all or part of the sums due by him or make compensation. When the client is late for a total or partial payment of a maturity to be completed, Fraise & Bois may, therefore, and without the need for a prior notice, immediately suspend the deliveries, without the client being able to claim damages to Fraise & Bois. In case of litigation, Fraise & Bois is entitled to claim to the client, the reimbursement of any costs related to the prosecution.

Article 8: Satisfaction or refund

Under the conditions set out in article L121-16 of the Consumer Code and within the framework of the remote sale, the customer has a 14-day withdrawal period from the delivery of the order.
WARNING:All items at the cutting, in a meter, custom, with engraving or special order for a customer cannot be returned and refunded.

The return of goods can therefore be made under the following conditions:
- Any revocation must be the subject of a return request via the form available from the "Contact Us" section or by mail to contact@fraise-et-bois.fr. The customer will then receive a receipt of his request by email. Fraise & Bois will send by email a return number that the Customer will clearly indicate on the packaging of his package. No return will be accepted without this return number.
- The products must be in perfect condition, must not have been used and must be complete and returned in their original packaging.
- Transport costs related to the return of products and potential packaging costs are borne by the customer.
- Any parcel sent to Fraise & Bois must be in a "followed" postal format (Letter followed, Colissimo followed, package recommended, or Chronopost).In case of litigation, Fraise & Bois will require the Customer proof of deposit at the postal service.
- Once the package is received by Fraise & Bois, we will judge the perfect condition of the returned merchandise. In case the returned products have been visibly used, worn, damaged, damaged, soiled etc... the customer's liability will be incurred and a refund of the value of the product may be applied.
- In case the returned products were unfit for sale, the return may be refused by Fraise & Bois. The products will then be returned to the Customer at the cost of Fraise & Bois without the Customer being able to require any compensation or right to reimbursement, except for the subsequent exercise of its warranty rights on the goods sold.

Strawberry-et-bois.fr reserves the right to refuse the parcel and refund if the aforementioned return conditions are not met.

Article 9: Refund

In case Fraise & Bois a refund of products will be made by the same payment method as the one used for the payment of the order within 14 days of receipt of the products.
In the case of a return of parcel due to NPAI (complete or erroneous address) or not recovered from the specified withdrawal point and within the time limits, the shipping costs will be deducted from the total refund of the order.

Article 10: Legal guarantees

According to articles L.211-4 et seq. of the Consumer Code, Fraise & Bois is held of compliance defects.Thus, as part of the legal compliance guarantee, the consumer:
- receives a period of two years from the grant of the property to act;
- may choose between repair or replacement of the property, subject to the cost conditions provided for in article L. 211-9 of the Consumer Code;
- is exempt from reporting evidence of the failure to comply with the property within six months of the issuance of the property. This deadline is extended to twenty-four months from March 18, 2016, except for used goods.
- According to articles 1641 et seq. of the Civil Code, the seller is bound by the guarantee because of the hidden defects of the thing sold that make it unfit for the use to which it is intended, or that so diminish this use that the buyer would not have acquired it, or would have given it only a lesser price if he had known them.

Article 11: Accountability

Fraise & Bois, in the online sales process, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service failure, or other involuntary problems.

Article 12: Intellectual property

All elements of the site Fraise & Bois are and remain the intellectual and exclusive property Fraise & Bois. No one is allowed to reproduce, exploit, rebroadcast, or use, in any way, even in part, elements of the site, whether software, visual or audio, unless previously agreed.

Article 13: Personal data

In accordance with the provisions of the Information and Freedoms Act of 6 January 1978 (amended by the Act of 6 August 2004 on the protection of natural persons with regard to personal data processing), you have the right to access, rectify or object to the personal data collected. In order to respect your privacy and to preserve your personal data, we do not release nominal data on our site except your nickname when you participate in the community Fraise & Bois (comments, blog...).

Article 14: Applicable law and jurisdictional jurisdiction

The consumer may apply to his or her choice, in addition to the jurisdictions that are territorially competent under the Civil Procedure Code, the jurisdiction of the place where he or she remained at the time of the conclusion of the contract or the occurrence of the wrongful act. This contract is governed by French law. In the event of a dispute, the French courts will be solely competent.

Article 15: Implementation of the GDPR
